Notification of national measures derogating from the principle of the free movement of goods
The 98/34/EC Directive (formerly 83/189/EEC) sets up a procedure which imposes an obligation upon the Member States to notify to the Commission and to each other all the draft technical regulations concerning products and Information Society Services before they are adopted in national law. Such procedure aims at providing transparency and control with regard to those regulations. Since they could create unjustified barriers between Member States, their notification in the draft form and subsequent evaluation of their content in the course of the procedure help to diminish this risk.

By a Statement of December 10th, 2006, the ministry of Agriculture published the list of the 47 most dangerous substances according to their TGAP classification. TGAP (Taxe générale sur les activités polluantes - general Tax on polluting activities) relates to the community classificatiuon of dangerous substances directive 67/548/EEC :

Modifications concernant l'évaluation par l'Afssa des produits phytopharmaceutiques
Un décret, publié au JO du 23 septembre 2006, modifie le chapitre III du titre II du livre III du Code de la santé publique. Ces modifications concernent l'évaluation par l'Agence française de sécurité sanitaire des aliments (Afssa) des produits phytopharmaceutiques, matières fertilisantes et supports de culture.

Un arrêté, publié au JO du 22 septembre 2006, fixe le montant des droits exigibles pour la mise sur le marché des produits phytopharmaceutiques.
Nombre d'exemplaires à fournir pour chaque type de demande
Un avis, publié au JO du 11 octobre 2006, adressé aux demandeurs d'autorisation de mise sur le marché de produits phytopharmaceutiques, y compris leurs adjuvants, ou d'homologation de matières fertilisantes, précise le nombre d'exemplaires à fournir pour chaque type de demande à adresser à l'Agence française de sécurité sanitaire des aliments (Afssa).
Nouvelles règles de mise sur le marché et d'utilisation des produits phytopharmaceutiques
Un arrêté, publié au JO du 21 septembre 2006, modifie l'arrêté du 6 septembre 1994 portant application du décret n° 94-359 du 5 mai 1994 relatif au contrôle des produits phytopharmaceutiques : sont ajoutés les principes uniformes pour l'évaluation et l'autorisation des produits phytopharmaceutiques contenant des micro-organismes. En outre, un deuxième arrêté, publié au même JO, fixe les dispositions relatives à l'utilisation des produits, à la limitation des pollutions ponctuelles et aux zones non traitées au voisinage des points d'eau. Cet arrêté est accompagné d'un avis.
